There is evidence that the current process, in which the federal government identifies WHCA claims after they have been paid as DBA claims and then reimburses insurers for claim and administrative costs, results in the federal government paying significant amounts that do not go directly to claimants.

Over the past six years under the WHCA, the federal government has paid more in reimbursements to insurers for expenses ($19.7 million) than it has paid in compensation
to claimants ($12.1 million).

There is also evidence, including testimony provided by DBA and WHCA claimants at a 2009 House Committee on Oversight and Government Reform hearing, that in some cases, claimants with injuries that clearly fall under the statutory requirements of the WHCA must first navigate procedural and other requirements of their contractors’ DBA insurers before their cases are eventually transferred to DOL.

In some cases, DBA insurers controvert claims or oppose specific benefits for claims that are likely to end up at the DOL under the WHCA. Under the current system, insurers have the right and responsibility to investigate all claims and controvert or oppose claims and benefits they feel are not their responsibility or that fall outside of the DBA.

However, this can cause delays for claimants, including claimants with clear WHCA cases that will eventually be paid by the DOL.

I don’t know how else anyone can explain how the insurance companies get so much more than people with severe injuries, extreme injuries, and deaths !!

the insurance company is responsible.. period.
Let me put it to you like this.. if you are crippled, blind, and deaf. and a miracle occurs and you can walk and talk and hear.. you get a job go overseas and work 1 day… and then bammm your cripple and blind again… the insurer is 100% responsible. because under DBA they are responsible for PRE-Existing injuries that are exasperated..
therefore understanding this.. when these contractors are hiring combat soldiers for their positions. they come into the job with PTSD.. so what do you think happens when they are sent back into a combat zone? hummm it gets worse… meaning the insurance company is now on the hook.
o yeah by the way CNA, AIG, and their lawyers and Investigators.. everyone has PTSD.. everyone.
so stop screwing around and take care of the worriers … due to your lack of care 2 have committed suicide in the past few months.. and you will pay for that …

The LAW is set up specifically to avoid miscarriages of justice like what happened to me.
Not even talking mental difficulties…we are talking full on MRI from Kuwait and they lied and said it was all “pre-existing” and had nothing to do with my multi-year time in Iraq working 12/7′s!!!!!!!!!!!!!!!
AND THEN THE FRIKIN BRB AGREES ??!!

Firstly Michelle let me thank you for your lovely email what a surprise also I would like to thank Dr Gill Biden for the lovely email she sent me a couple of months ago. I would also like to thank her husband Joe for the lovely email he sent me too about the waste taking place in federal government it came as a lovely surprise too.

Like millions of American families, the Federal Government has to take a hard look at spending and live within its means. Most of these cuts we’re going to make are small. They won’t close our deficit or solve all of our fiscal problems. However, no amount of waste is acceptable, and these cuts will add up over time. This year alone we’ve found $33 billion in savings, but we know there’s a lot more work to be done.
So whilst we are on the subject of waste Joe what about the money you waste paying the insurance industry to fight the claims of those who serve out of uniform.

Maybe Joe you and your good wife could get together with Michelle and her good husband and work out how you are going to support the injured contractors and their families after most served in uniform at some point.

Good morning,
Did you know that the government spends millions to maintain buildings that have sat vacant for years? Or that your tax dollars pay to needlessly ship copies of the Federal Register to thousands of government offices across the country even though the same information is available online?
And I bet you didn’t know that your tax dollars pay for a website dedicated to the Desert Tortoise. I’m sure it’s a wonderful species, but we can’t afford to have a standalone site devoted to every member of the animal kingdom. It’s just one of hundreds of government websites that should be consolidated or eliminated.
This kind of waste is just unacceptable. Particularly at a time when we’re facing tough decisions about reducing our deficit, it’s a no-brainer to stop spending taxpayer dollars on things that benefit nobody.
That’s why President Obama asked me to head up the Campaign to Cut Waste—a new effort to root out wasteful spending at every agency and department in the Federal Government.

When we passed the Recovery Act back in 2009, President Obama insisted that we use that program to set a new standard in government transparency and accountability. And he appointed me as “Sheriff Joe” to make sure the job gets done.
Now, there were a lot of naysayers back then who said that there was no way we could implement the Recovery Act without massive waste, fraud and abuse.
You know what? They were wrong. Thanks to our diligence (and some help from advanced computer models and sophisticated data analysis), the Recovery Act has had an unprecedentedly low level of fraud, with less than 0.6% of all awards experiencing any waste or abuse.
There’s absolutely no reason why we can’t apply these same principles and techniques to all government spending.
And that’s exactly what I intend to do with the help of a new Government Accountability and Transparency Board, a group composed of independent inspectors general and high-level agency officials who will help me root out waste, fraud and abuse across the government. Helping me ensure that your tax dollars are being spent on things that matter, like investments in education, innovation and improving our infrastructure.
So, folks, we’re changing the way your government does business (and spends your hard-earned tax dollars), and I think you’re going to like the results.
